1. Introduction

KVT-Fastening GmbH appreciates your interest in our company, products and services. The protection of your personal data during the entire business process is an important concern for us. We therefore treat your data confidentially and in accordance with the legal data protection regulations: All our employees are bound to secrecy. In addition, the company's data protection officer ensures that this data protection declaration is observed and complied with.

2. General data protection declaration according to articles 13 and 14 DS-GVO 

In the following, we would like to inform you about how KVT-Fastening GmbH treats your personal data and which rights you have with regard to the use of your data.

Personal data are all data that can be related to you personally, e.g. name, address, e-mail addresses or user behavior.

2.2. Purposes of data processing, legal bases and legitimate interests pursued by the data controller or a third party and categories of personal data processed

KVT-Fastening GmbH processes personal data in the course of cooperation with business partners (customers, suppliers/external service providers, sales partners, partners, interested parties), in application procedures (applicants), for advertising measures as well as for the protection of further legitimate interests of the responsible person or a third party.

2.2.1. Initiation, implementation and termination of a contract

The following categories of your data are processed in order to carry out pre-contractual measures, to fulfil and to terminate a contract with you (e.g. manufacturing products, ordering products and services, brokering products and services, selling products and services, carrying out deliveries, maintenance work or repairs, keeping a history of deliveries and services, invoicing the delivered products and services), in connection with the necessary communication, for marketing measures (including the provision of information on products and services), to comply with legal requirements (e.g. tax and commercial law retention obligations) as well as the settlement of legal disputes, enforcement of existing contracts, assertion, exercise and defense of legal claims:

  • Personal data: Salutation, title, first name, surname, function, profession/sector and comparable data,
  • Contact details: Company name, address, telephone number, mobile phone number, e-mail address and comparable data,
  • Payment data: Creditworthiness data, information required for the processing of payment transactions, bank details,
  • History of customer relations: inquiries about/interest in products and services, deliveries of products and services (history of deliveries and services),
  • Further information, the processing of which is necessary within the scope of the business relationship or the execution of a contract, e.g. contractual conditions, or which you have provided voluntarily, e.g. within the scope of orders placed or inquiries made.

Legal basis:

  • For the initiation, fulfilment or termination of a contract with you, Art. 6 para. 1 letter b DS-GVO forms the legal basis for the processing of your personal data.
  • If you have given us your consent to process your personal data or if you have provided data voluntarily, this constitutes the legal basis for the processing in accordance with Art. 6 para. 1 letter a DS-GVO.
  • Insofar as the processing of your personal data is necessary to fulfill our legal obligations, we are authorized to do so in accordance with Art. 6 para. 1 letter c DS-GVO.
  • In addition, in accordance with Art. 6 para. 1 letter f of the DS-GVO, we process personal data for the purposes of safeguarding our legitimate interests as well as the legitimate interests of third parties, provided that your interests or fundamental rights and freedoms do not prevail.
  • The legitimate interests of KVT-Fastening GmbH consist in the marketing of its own and third-party products and services (business activities), combined with marketing measures. Furthermore, there may be legitimate interests of KVT-Fastening GmbH for the settlement of legal disputes, enforcement of existing contracts, assertion, exercise and defense of legal claims.

2.2.2. Application procedure

The following categories of your data are processed in the application process for the purpose of filling new positions (e.g. reviewing application documents, conducting aptitude tests, job interviews, sending out invitations and rejections) and in connection with the communication required for this purpose, as well as for the settlement of legal disputes, enforcement of existing contracts, assertion, exercise and defense of legal claims, if applicable:

  • Personal data: Salutation, title, first name, surname, resume, qualifications, results of aptitude tests and comparable data,
  • Contact details: Address, telephone number, mobile number, e-mail address and comparable data,
  • Other data that you have provided voluntarily: e.g. racial and ethnic origin, health data, hobbies.

Legal basis:

  • The legal basis for the processing of your applicant data in the event of job vacancies is derived from Art. 88 DS-GVO in conjunction with §26 BDSG.
  • If you have given us permission to process your personal data (e.g. for storage in the applicant pool) or if you have provided data voluntarily (including unsolicited applications), this constitutes the legal basis for processing in accordance with Art. 6 para. 1 letter a DS-GVO.
  • In accordance with Art. 6 para. 1 letter f DS-GVO, we process personal data for the purpose of safeguarding our legitimate interests as well as the legitimate interests of third parties, unless your interests or fundamental rights and freedoms prevail.
  • The legitimate interests of KVT-Fastening GmbH consist in the settlement of legal disputes, enforcement of existing contracts, assertion, exercise and defense of legal claims.

2.2.3. Data processing for advertising purposes

In order to acquire new customers, carry out customer surveys, market analyses, marketing campaigns, lotteries, competitions or similar actions and events, the following categories of your data are processed within the scope of the legal requirements:

  • Personal data: Salutation, title, first name, surname, function, profession/sector and comparable data,
  • Contact details: Company name, address, telephone number, mobile phone number, e-mail address and comparable data,
  • Data on advertising measures: products and services advertised, response.

Legal basis:

  • If you have given us your consent to process your personal data or if you have provided data voluntarily, this constitutes the legal basis for the processing in accordance with Art. 6 para. 1 letter a DS-GVO.
  • In addition, in accordance with Art. 6 para. 1 letter f DS-GVO, we process personal data for the purposes of safeguarding our rectified interests as well as the legitimate interests of third parties, provided that your interests or fundamental rights and freedoms do not prevail.
  • The legitimate interest of KVT-Fastening GmbH consists of direct advertising - direct promotional contact with you - for the purpose of marketing our own and third-party products and services (business activity), combined with the provision of appropriate information.

2.2.4. Receipt of business cards/data from interested parties

After receiving business cards or personal data from interested parties, the following categories of your data will be processed:

  • Personal data: Title, first name, surname, function, profession and comparable data,
  • Contact details: Company name, address, telephone number, mobile phone number, e-mail address and comparable data,
  • Overall circumstances of the receipt of the data: e.g. event, time,
  • Other data that you have provided voluntarily.

These data serve

  • the initiation of a contract with you (see "2.2.1. Initiation, implementation and termination of a contract"),
  • the advertising approach, unless you have lodged an objection to advertising in accordance with Art. 21 para. 2 DS-GVO (see "2.2.3. Data processing for advertising purposes")
  • the maintenance and care of personal contacts,
  • the documentation of the overall circumstances of the receipt of your data.

Legal basis:

  • If you have given us your consent to process your personal data or if you have provided data voluntarily, this constitutes the legal basis for the processing in accordance with Art. 6 para. 1 letter a DS-GVO.
  • For the initiation, fulfilment or termination of a contract with you, Art. 6 para. 1 letter b DS-GVO forms the legal basis for the processing of your personal data.
  • In addition, in accordance with Art. 6 para. 1 letter f of the DS-GVO, we process personal data for the purposes of safeguarding our legitimate interests as well as the legitimate interests of third parties, provided that your interests or fundamental rights and freedoms do not prevail.
  • The legitimate interests of KVT-Fastening GmbH consist in direct advertising - direct promotional contact with you - for the purpose of marketing its own and third-party products and services (business activity), combined with the provision of appropriate information, in maintaining and cultivating personal contacts and in documenting the overall circumstances of the receipt of your data for the purpose of proving that you have given your consent.

2.2.5. Ensuring the proper operation of data processing

The following categories of your data are processed to ensure proper data processing operations and thus to maintain the functionality of our IT systems as well as to settle legal disputes, enforce existing contracts, assert, exercise and defend legal claims:

  • Access data: username, e-mail address,
  • Connection data: IP address, phone number, mobile phone number, fax number and comparable data,
  • Timestamp: date, time.

Legal basis:

  • If you have given us your consent to process your personal data or if you have provided data voluntarily, this constitutes the legal basis for the processing in accordance with Art. 6 para. 1 letter a DS-GVO.
  • Otherwise, in accordance with Art. 6 para. 1 letter f DS-GVO, we process personal data for the purposes of safeguarding our legitimate interests and the legitimate interests of third parties, provided that your interests or fundamental rights and freedoms do not prevail.
  • The legitimate interests of KVT-Fastening GmbH consist in the provision of control mechanisms, log files, logs, authorization, security and backup procedures as well as in the prevention and detection of security risks. Furthermore, there are legitimate interests of KVT-Fastening GmbH for the settlement of legal disputes, enforcement of existing contracts, assertion, exercise and defense of legal claims.

2.3. Categories of beneficiaries/transfer to third parties (external bodies)

  • Within KVT-Fastening GmbH, those entities receive your personal data that require it to fulfill our contractual and legal obligations (Art. 6 para. 1 letters b and c DS-GVO).
  • If we use the services of external service providers (e.g. IT service providers, document destruction companies), your data may be transferred to them. The contractual relationships with these external service providers are governed by the statutory data protection provisions; the data transferred may be used by the recipient exclusively for the contractually agreed purpose of their transfer (Art. 28 DS-GVO).
  • In principle, your data will only be passed on to third parties (suppliers, sales partners, partners, transport companies) if this is legally permissible and necessary for the purpose of processing the contract (Art. 6 para. 1 letter b DS-GVO). Here too, the data transmitted may be used by the recipient exclusively for the purpose of passing them on.
  • In addition, your personal data will only be passed on to third parties if you have given your express prior consent (Art. 6 para. a DS-GVO). You will receive more detailed information in connection with the consent we have requested.
  • Due to legal obligations or court decisions, your data will be transferred to public authorities (Art. 6 para. 1 letter c DS-GVO).
  • Furthermore, we reserve the right to pass on your personal data to third parties (lawyers, courts, authorities) or to the criminal prosecution authorities for the purpose of enforcing our rights, in particular to enforce claims arising from a contractual relationship (Art. 6 para. 1 letter f DS-GVO).

Furthermore, we will not pass on your personal data to third parties.

Data will only be transferred to third countries (countries outside the European Economic Area (EEA)) or to an international organization if this is necessary for the fulfillment of a contract and only in compliance with the data protection requirements prescribed for this purpose or if required by law. The basis for the transfer in this case is Art. 45 DS-GVO (data transfer on the basis of a decision of adequacy) | Art. 46 DS-GVO (data transfer subject to appropriate guarantees) | Art. 47 DS-GVO (binding internal data protection provisions) | Art. 49 para. 1 subpara. 2 DS-GVO. Furthermore, we will only transfer data to third countries or to an international organization if you have given us your consent. You will receive more detailed information in connection with the consent we have requested.

2.4. Retention period - Deletion periods

Your stored personal data will be deleted after the complete execution of the contract and after the expiry of the retention periods of the tax and commercial law regulations, unless you have expressly agreed to data processing beyond this. Furthermore, your data will be deleted when the purpose of the data processing no longer applies. Thus, at the latest three months after the completion of a new job, your data will be deleted, unless you give us your consent to store your applicant data for a longer period of time.

2.5. Your rights

Zur Ausübung Ihrer Rechte wenden Sie sich bitte an den Verantwortlichen oder den Datenschutzbeauftragten (Kontaktdaten: siehe "2.1. Verantwortlicher und Datenschutzbeauftragter"). 2.5.1. Right of information

At any time and without giving reasons, you will receive free information about the data stored concerning your person, its origin, recipients to whom the data is passed on, and the purpose of the data processing (Art. 15 DS-GVO).

2.5.2. Right of rectification

Furthermore, you have the right to have incorrect personal data corrected or your personal data stored by us completed (Art. 16 DS-GVO).

2.5.3. Right of deletion

You can request the deletion of your personal data, unless other legal regulations require us to retain it (Art. 17 DS-GVO).

2.5.4. Right to limit processing

You also have the right to restrict the processing (blocking) of data concerning you (Art. 18 DS-GVO).

2.5.5. Right of data transferability

You also have the right to have data that we process automatically on the basis of your consent or in fulfilment of a contract handed over to you or to third parties (data transferability) (Art. 20 DS-GVO). The data is provided in a common, machine-readable format. If you request the direct transfer of the data to another responsible person, this will only take place to the extent that it is technically feasible.

2.5.6. Right to revoke a granted consent

You can revoke your consent to the processing of your personal data at any time and free of charge for the future without giving reasons (Art. 7 para. 3 DS-GVO). As a result, we may no longer continue to process the data based on this consent for the future. The legality of the processing of your personal data until revocation is not affected by the revocation. Any further processing of your data on the basis of another legal basis will also remain unaffected.

2.5.7. Right to appeal to a supervisory authority

If you are of the opinion that the processing of your personal data by us violates legal requirements, you have a right of appeal to a data protection supervisory authority (Art. 77 DS-GVO). As a rule, you can turn to the supervisory authority of your usual place of residence or workplace.

2.6. Right to object to the processing

If the processing of your personal data is based on legitimate interests in accordance with Art. 6 para. 1 letter f of the DS-GVO, you can object to future processing at any time, provided there are reasons for doing so that arise from your particular situation (Art. 21 para. 1 DS-GVO). This also applies to profiling based on these provisions within the meaning of Art. 4 No. 4 DS-GVO. If you submit an objection, we will no longer process your personal data unless we can prove compelling reasons for processing that are worthy of protection and outweigh your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.

In addition, you can at any time object to the processing of your personal data for the purposes of direct marketing and the associated profiling (data analysis) (Art. 21 para. 2 DS-GVO). We will take this objection into account for the future.

2.7. Possible sources of personal data

If we do not collect your personal data directly from you, we use publicly accessible sources, information databases or credit agencies.

2.8. Is there an obligation to provide data?

Within the scope of our business relationship, you only need to provide us with the personal data that we need to initiate, implement or terminate this relationship or that we are legally obliged to collect. Without the provision of this data, we may have to refuse to conclude a contract or may no longer be able to execute an existing contract or may even have to terminate a business relationship.

2.9. Is there automated decision making in individual cases including profiling?

KVT-Fastening GmbH does not use automated evaluation systems.

2.10. Data security

To protect your personal data stored by us against unauthorized access by third parties, manipulation and partial or complete loss, we use appropriate technical and organizational security measures. These security measures are continuously adapted according to technological developments or other new findings.

We would like to point out that data transmission over the internet (e.g. communication by e-mail) can have security gaps, making complete protection of your data against access by third parties impossible. Therefore, sensitive data should either not be transmitted at all or only via a secure connection or encrypted.

3. Data processing on the website (internet pages)

This data protection declaration supplements the explanations given in the chapter "2. General data protection declaration according to articles 13 and 14 DS-GVO". In the following, we explain which data we at KVT-Fastening GmbH, or under certain circumstances an external service provider commissioned by us, collect during your visit to our websites and how this data is used.

This data protection declaration applies to all websites for which we are responsible. However, our internet pages may contain links to external companies to which our data protection declaration does not refer.

3.1. Basic information on data collection and processing

3.1.1. Data transmitted by browser/internet technology

When using the web pages for informational purposes only, i.e. if you do not register or otherwise provide us with information, your internet browser automatically sends the following data to us or to our web page operator (provider):

  • Date and time of your visit,
  • Website that you visit,
  • Access status/HTTP status code,
  • Duration of your visit,
  • Website from which you visit us (referrer URL),
  • Browser type, version and language,
  • the operating system of the computer used.

These pseudonymized data are stored in a log file of the server, so-called server log file, for technical and statistical purposes and processed by us for the following purposes:

  • Ensuring a smooth connection of the website,
  • Guarantee a comfortable use of our website,
  • Ensuring system security and stability,
  • in case of system abuse to determine the cause and the trigger of the abuse.

The legal basis for data processing is Art. 6 para. 1 letter f DS-GVO. Our legitimate interest follows from the above listed purposes for data processing. The above-mentioned data is stored separately: a combination of this data with any personal data you may have provided is not carried out; thus, no conclusions can be drawn about a specific person.

The data will be deleted when they are no longer necessary for the achievement of the purposes, at the latest after 30 days.

3.1.2. Cookies

We use so-called cookies on our website. Cookies are small text files that your internet browser automatically creates and stores on your end device (PC, laptop, tablet, smartphone or similar) so that the browser can retrieve them later. Cookies cannot execute programs. Our cookies do not cause any damage to your end device, they do not contain viruses, trojans or other malware.

Cookies are distinguished according to their storage duration in

  • transient cookies: Transient cookies are automatically deleted when you log out or close your internet browser. These cookies are used to ensure the function of the internet pages and to make the internet offer as a whole more user-friendly and effective.
  • persistent cookies: Persistent cookies are automatically deleted after a specified period of time, which may vary depending on the cookie. This means that they are stored on your end device for a longer period of time - usually up to two years. These cookies are used for your recognition: They enable us to present you with advertisements based on your visit to our website.

Most browsers automatically accept cookies. You can, however, control the storage of cookies on your terminal device by making the appropriate settings in your browser. Your browser can be configured in such a way that you are informed about the setting of cookies and allow cookies only in individual cases or refuse to accept cookies for specific cases or in general, and thus block third-party cookies if necessary. Do not accept cookies on end devices that are used by several people without user management (personal login with secret password) (such as in an internet café), otherwise there is a risk of data misuse by the other users. 3.1.2.1. Categorization of cookies

Depending on their function and purpose, cookies can be divided into four categories.

3.1.2.1.1. Technically required, necessary (transient cookies)

These cookies, also called session cookies, are necessary for error-free operation and thus for a problem-free visit to our internet pages; without the technically required cookies, our web pages will not function. Session cookies control the connection during your visit to our website or, for example, store the contents of your shopping cart in the online store. Session cookies can contain personal data. However, these cookies are only temporarily stored on your end device, i.e. they are automatically deleted when you close your browser. We are responsible for session cookies, i.e. these are so-called cookies from first-party providers ("First Party Cookies").

The aforementioned purposes of the cookies represent our legitimate interest. The legal basis for data processing is Art. 6 para. 1 letter f DS-GVO.

If you object to the use of technically required cookies, the full functionality of our websites is no longer guaranteed.

3.1.2.1.2. Individual settings (preferences) (persistent cookies)

Some cookies are used to make our website more user-friendly. For this purpose, for example, the selected language for displaying the web pages is stored. This type of cookie is stored for a longer period of time so that your settings will be retained for your next visit to our internet pages. These cookies do not contain any personal data, but only the values with which the respective setting is designated. We are also responsible for this type of cookies (cookies from first-time providers).

Functional cookies are also used to enable requested functions, such as video playback, by storing the region in which you are located (location). In this case, these are so-called Flash cookies, officially called "Local Shared Objects". These objects store the required data regardless of the browser you use and do not have an automatic expiration date. The Flash cookies used are not recorded by your browser, but by the Flash Player, an extension of your browser (browser plug-in). The Flash Player manages the Flash cookies itself, since they come from a third party ("third-party cookies"). Therefore, you cannot manage Flash cookies directly in the browser. The browser plug-in respects the "Private Mode" setting in internet browsers. This means that all Flash cookies that were stored in this mode while using the internet will be deleted when you exit the "Private Mode". If you object to the use of these preference cookies, you will have to make your individual settings again on each visit. In addition, the functional range of our websites is only partially available.

3.1.2.1.3. Statistics (persistent cookies)

Furthermore, we use cookies in order to statistically record the use of our websites and thus to optimize our offers (see chapter "Web Analysis Services"). These cookies make it possible, in particular, to determine the frequency of use and the number of users of the web pages and to analyze the behavior of the site usage. The data collected from all users is summarized and is therefore anonymous. 3.1.2.1.4. Marketing (persistent cookies)

Marketing cookies are used to offer content that is more relevant to you and tailored to your interests (see chapter "Online Advertising"). The cookies are also used to limit the frequency with which an advertisement appears and to measure and control the effectiveness of advertising campaigns. They register whether a website has been visited or not, and which content has been used (tracking). The data collected by these cookies may be shared with third parties, such as advertisers, where appropriate. Marketing cookies are often linked to page functionalities of third parties. These cookies remain stored when you stop using your internet browser and are retrieved the next time you visit our site; they are automatically deleted after a specified period of time.

If you object to the use of marketing cookies, the full functionality of our websites is still guaranteed. However, you may be offered ads that do not match your interests.

3.2. Functions and offers of our website (Services)

In addition to the purely informative use of our internet pages, we offer various services which you can use if you are interested. For this purpose, you will generally have to provide additional personal data which we use to provide the respective service and to which the aforementioned data processing principles apply.

We may pass on your personal data to third parties if contracts are concluded, participation in promotions, competitions or similar services are offered by us together with partners. You will receive more detailed information on this when you provide your personal data or in the description of the offer below.

Insofar as our external service providers or partners are based in a state outside the European Economic Area (EEA), we will inform you about the consequences of this circumstance in the description of the offer.

3.2.1. Contact form

We offer you the possibility to contact us via a contact form. You provide us with the information voluntarily. At least

  • Your first name,
  • Your name,
  • Your company address,
  • Your company and
  • Your e-mail address,

and as further voluntary information

  • Your message and other contact details (telephone number) to which we should send our reply or where we can reach you,

are recorded and stored if this information is required for the purpose you have requested. Your personal data is therefore used to process and answer your request, e.g. an inquiry, and/or to process contracts concluded with you. We delete the data collected in this context after storage is no longer required or restrict processing if there are legal storage obligations.

There is no comparison of the data collected in this way with data that may be collected by other components and/or services of our websites.

Please remember that this means of communication is not suitable for sending confidential messages because of the currently missing possibilities of data encryption! For this purpose, we recommend that you send them by post.

3.2.2. Newsletter subscription

If you have expressly agreed, we will use your e-mail address to send you our newsletter on a regular basis and also to inform you from time to time about offers and promotions. To receive the newsletter, it is sufficient to provide your name and surname, your e-mail address and your company. The company information is required to identify you as a corporate customer. In addition, you can voluntarily select a form of address so that we can address you directly and personally in each newsletter.

At the end of each newsletter you will find a link that allows you to unsubscribe from the newsletter at any time. You can also unsubscribe from the newsletter at any time by sending an e-mail to newsletter@kvt-fastening.com.

3.2.3. Registration for our website

A comprehensive selection of documented know-how on fastening technology is available for download on our website. Downloading this information requires prior registration. In the course of registering for the Download Center, we collect the following data:

  • First name, last name
  • Company
  • e-mail address
  • Password

This data is collected in order to prevent misuse as far as possible and - if you have expressly consented - to send you further information by e-mail or our newsletter (see section 3.2.2.).

3.2.4. Registration for our E-Shop

If you wish to place product orders via the e-shop offered on our website, you must first register. In the course of the registration for our e-shop we collect the following data:

  • Company
  • Salutation, first name and surname
  • Address and country
  • Phone number
  • e-mail address

This information is mandatory for registration. In addition, you can also enter a website and your VAT number.

This data is collected,

  • to know who our contractual partner is;
  • for the establishment, content design, processing and modification of contractual relationships with you regarding your orders and the use of the e-shop;
  • to check the entered data for plausibility and release the registration;
  • to confirm your registration and set up access to your customer account in the e-shop;
  • to contact you in case of further questions.
